Apple price-fixing case back in court Aug. 9, DoJ proposes “remedies,” and more

The U.S. Department of Justice has proposed a number of remedies to address Apple’s ebook price fixing, a month after the court found that the company conspired, along with publishers, to raise ebook prices by introducing agency pricing. The court will hold a hearing on the remedies Aug. 9.

  • To begin with, Apple would face a five-year ban from entering anti-competitive e-book distribution contracts
  •  Apple would be required to terminate its agreements with the five publishers implicated in the “conspiracy” (Hachette, HarperCollins, Macmillan, Simon & Schuster, and Penguin), under the supervision of a court-appointed external monitor
  • Apple would be required to cover the costs of this monitor
  • Apple would also be required to allow other ebook retailers like Amazon and Barnes & Noble to provide links from their ebook apps to their e-bookstores, allowing consumers who purchase and read ebooks on their iPads and iPhones easily to compare Apple’s prices with those of its competitors
